Terms of Service

1. The service

Fam lets you share photo moments, short videos, captions, comments, and reactions with a private circle of people (“Fam”). The service is provided for personal, non-commercial use among people you know and trust.

We may update, suspend, or discontinue features with reasonable notice where practicable. Fam is currently offered for iPhone; availability may change.

2. Eligibility

You must be old enough to enter a binding agreement where you live (typically at least 13, and 18+ unless you have verifiable parental consent). You represent that the information you provide is accurate and that you will keep your account credentials secure.

You may not use Fam if you are barred from receiving services under applicable law or if we have previously terminated your account for violation of these Terms.

3. Your account

You may sign in with Apple, email one-time passcode, or phone one-time passcode. You are responsible for activity on your account and for maintaining access to your email or phone number.

Notify us promptly at support@fam.day if you suspect unauthorized access.

4. Your content

You retain ownership of photos, videos, text, and other material you upload ("Content"). You grant us a limited license to host, store, reproduce, display, and transmit Content solely to operate Fam for you and the members of your Fam, including generating thumbnails, processing media formats, and enforcing access controls.

You represent that you have the rights to share Content and that it does not violate law or third-party rights.

5. Private circles

Content you post is visible to members of the Fam it belongs to, not to the public. You are responsible for who you invite or admit into your circle. Fam is not responsible for how other members use or redistribute content outside the app once they have lawful access within your circle.

6. SMS and electronic communications

By providing a phone number and requesting a verification code, you consent to receive automated, transactional SMS from us or our providers (which may include Twilio) for authentication and essential account notices. This consent is not a condition of purchase where prohibited by law.

• Messages are for verification and account security, not marketing, unless you separately opt in.
• Frequency varies with sign-in activity.
• Message and data rates may apply.
• Reply STOP to cancel non-essential SMS; HELP for help; or contact support@fam.day.

Email codes and in-app notices may also be used for the same purposes. See our Privacy Policy for how we handle contact information.

7. Acceptable use

You agree not to:

• Upload illegal, infringing, harassing, exploitative, or non-consensual intimate content.
• Attempt to access another user’s account, Fam, or private media without authorization.
• Reverse engineer, scrape, overload, or interfere with the service or its security.
• Use Fam for spam, unsolicited commercial messaging, or bulk automated activity.
• Misrepresent your identity or impersonate others.

We may remove Content or suspend accounts that violate these rules or pose risk to users or the platform.

8. Intellectual property

Fam, its design, logos, and software are owned by Aether and its licensors. These Terms do not grant you any right to our trademarks or brand assets except as needed to use the app as intended.

9. Third-party services

Fam relies on third-party infrastructure (including Supabase, Apple Sign in, and telecommunications providers). Your use of those services may be subject to their terms. We are not responsible for third-party services outside our control.

10. Disclaimers

Fam is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

11. Limitation of liability

To the fullest extent permitted by law, Aether and its affiliates, officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of Fam.

Our total liability for any claim relating to Fam or these Terms is limited to the greater of (a) amounts you paid us for Fam in the twelve months before the claim, or (b) USD $100.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum permitted by law.

12. Indemnity

You will defend and indemnify Aether against claims arising from your Content, your use of Fam, or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or willful misconduct.

13. Termination

You may stop using Fam at any time. We may suspend or terminate access if you violate these Terms, create risk, or where required by law. Upon termination, your right to use Fam ends; sections that by nature should survive (including limitations of liability and dispute terms) will survive.

You may request account deletion by contacting support@fam.day.

14. Disputes and governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence apply.

Before filing a claim, you agree to contact us at support@fam.day and attempt to resolve the dispute informally within 30 days. If we cannot resolve it, disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise.

15. Changes

We may modify these Terms. We will post the updated version with a new “Last updated” date. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using Fam and delete your account.
